Tensions flared in Abia State as Chief Lateef Fagbemi, the nominated Attorney-General and Minister of Justice, made an appearance at the Abia State Election Petition Tribunal in Umuahia. Fagbemi is the lead counsel for Mr. Alex Otti in a case brought forward by Chief Okey Ahiwe, challenging Otti’s declaration as the winner of the March 18, 2023, governorship election in the state.
Although Fagbemi did not officially declare his presence, his seating with Mr. Alex Otti’s legal team was viewed by some present lawyers as an attempt to intimidate the tribunal members. Some legal experts questioned Fagbemi’s decision to continue representing private cases after being nominated, screened, and confirmed as a Federal Minister, especially one with the portfolio of Attorney-General and Minister of Justice.
Critics noted that Fagbemi’s involvement in private matters, while holding a public office, could potentially raise doubts about his impartiality and integrity in his role as Minister of Justice. Comparisons were drawn to lawmakers who, upon becoming ministers, quit their former roles to focus on their ministerial duties and Senate screening.
The Abia Renaissance Movement (ARM) issued a statement expressing concern over Fagbemi’s dual role and its potential impact on the judicial process. The ARM urged the tribunal panel to remain steadfast, independent, and undeterred by any attempts at intimidation or manipulation. They called on President Bola Ahmed Tinubu to address the situation and ensure that Fagbemi’s actions do not tarnish the administration’s reputation.
The incident has sparked a broader discussion about the ethical responsibilities of public officials in maintaining impartiality and avoiding conflicts of interest, particularly when it comes to legal matters involving public figures.
