The Federal High Court in Lagos has ruled in favor of Orits Wiliki, awarding him the sum of N50 million as damages for the loss of revenue in a recording dispute against Premier Records. Mr. Wiliki had filed a suit against Premier Records concerning the use and sales of the albums “Tribulation,” “Conqueror,” and “Wha’ Dis Wha’ Dat.”
The court, in its decision, held that the recording contract between Orits Wiliki and Premier Records expired after 25 years from the release of the album. Additionally, the court found the recording contract relied upon by Premier Records to be inconsistent.
As a result, the Federal High Court issued an order of perpetual injunction against Premier Records, restraining them from further use or sale of the albums “Tribulation,” “Conqueror,” and “Wha’ Dis Wha’ Dat.” This legal resolution marks a significant development in the ongoing dispute, providing clarity on the contractual terms and protecting Orits Wiliki’s rights to his artistic work.
The N50 million awarded as damages reflects the court’s recognition of the financial impact and loss of revenue suffered by Orits Wiliki due to the disputed use and sales of the albums. The ruling underscores the importance of upholding contractual agreements in the entertainment industry and ensuring fair compensation for artists.
