The High Court of Justice in the Federal Capital Territory (FCT) has issued an order directing Senator Samuel Anyanwu to desist from presenting himself as the National Secretary of the Peoples Democratic Party (PDP). This ruling comes as a result of a motion filed by party member Douglas Nwachukwu, seeking legal intervention in the matter.
Justice M. M. Adamu, presiding over the case, made the decision in response to the motion dated October 30. The court’s ruling restrains Senator Anyanwu from carrying out the functions associated with the position of the PDP National Secretary. This follows a similar order from a high court in Enugu, urging Senator Anyanwu to step aside from the role.
In the motion presented by Nwachukwu’s lawyer, F. S. Jimba Esq., several reliefs were sought. These included an interlocutory injunction to prevent the PDP, its National Working Committee, National Executive Committee, and other relevant entities from recognizing or dealing with Senator Anyanwu as the National Secretary until the substantive suit is determined. Additionally, an interlocutory injunction was sought to prevent Senator Anyanwu from acting or parading as the National Secretary during the same period.
The court, after hearing Barrister Jimba, granted the orders as requested. In summary, the court order prohibits the PDP and its associated bodies from acknowledging or engaging with Senator Anyanwu as the National Secretary until the substantive suit is resolved. It also restricts Senator Anyanwu from assuming or portraying himself as the National Secretary during this period.
The case is set to be heard in its entirety on January 24, 2024, providing a platform for the substantive issues to be addressed and resolved.
