The Independent National Electoral Commission (INEC) has taken significant steps in the prosecution of electoral offenders, including the Resident Electoral Commissioner (REC) deployed to Adamawa State, Barr. Hudu Yunusa Ari. This was discussed during the regular weekly meeting held by INEC on Thursday, July 6, 2023.
Following the conclusion of the investigation into alleged electoral offences during the 2023 General Election, INEC confirmed the receipt of case files from the Nigeria Police. The Commission assured Nigerians of immediate action regarding the matter during a meeting with the Resident Electoral Commissioners (RECs) on Tuesday, July 4, 2023.
According to the provisions of Section 145(1) of the Electoral Act 2022, electoral offences are triable in either a Magistrate Court or a High Court of the State where the offence was committed, including the Federal Capital Territory, Abuja. Additionally, Section 145(2) states that the prosecution of electoral offences shall be carried out by legal officers of INEC or appointed legal practitioners.
After reviewing the case file from the Police, which established a prima facie case against Barr. Hudu Yunusa Ari, INEC has filed a six-count charge against him at the Adamawa State High Court in Yola. The trial is scheduled to commence on Wednesday, July 12, 2023.
Furthermore, INEC is collaborating with the Nigerian Bar Association (NBA) to ensure diligent prosecution of other cases involving electoral offences.
These developments demonstrate INEC’s commitment to upholding the integrity of the electoral process and holding accountable those who engage in electoral misconduct.
