In a significant legal development, the Supreme Court has announced that it has reserved its judgment in the appeal brought by Atiku Abubakar and the Peoples Democratic Party (PDP) challenging the September 6 judgment of the Presidential Election Petition Court (PEPC). The PEPC’s judgment had affirmed the victory of President Bola Tinubu in the last presidential election.
A seven-member panel, presided over by Justice John Okoro, made this announcement after lawyers representing the parties involved presented their arguments and final submissions. The court also heard arguments from the appellants’ lawyers regarding a motion to supply fresh evidence.
Chris Uche, Senior Advocate of Nigeria (SAN) and the lawyer representing the appellants, urged the court to grant the motion, accept their appeal, and grant the requested prayers, including disqualifying President Tinubu.
On the other side, lawyers representing the respondents, including Abubakar Mahmoud, SAN (representing the Independent National Electoral Commission), Chief Wole Olanipekun, SAN (representing President Tinubu), and Chief Akin Olujinmi, SAN (representing the All Progressives Congress), urged the court to dismiss both the motion and the appeal, citing a lack of merit.
After a brief recess, the court reconvened to hear the appeal filed by the Allied Peoples Movement (APM).
In a related case, the Supreme Court has dismissed the appeal filed by the Allied Peoples Movement (APM) challenging the nomination of Kashim Shettima as the Vice Presidential candidate of the All Progressives Congress (APC) in the last presidential election. The dismissal was pronounced by a seven-member panel led by Justice John Okoro after the appellant’s lawyer, Chukwuma Majukwu Umeh, applied to withdraw the appeal.
The panel had previously noted that the appeal was frivolous, as the Supreme Court had already resolved the issue in a prior case involving the Peoples Democratic Party (PDP) against INEC and others, affirming the proper nomination of Shettima.
Justice Okoro pointedly questioned the appellant’s lawyer, Chukwuma Majukwu Umeh, about the utility of the case, and the lawyer ultimately chose to withdraw the appeal.
